Notice and Takedown Policy

Newcastle University seeks to observe the highest standards of compliance with the law and the rights of rights holders, while publishing research and teaching resources to support our students and staff and contribute to academic practice.

Nevertheless, if you are a rights holder and are concerned that you have found material on our website or legitimately under our name elsewhere, for which you have not given permission, or is not covered by a limitation or exception in laws of the UK or other countries (as relevant), please contact us in writing stating the following:

  1. Your contact details
  2. The full bibliographic details of the materials
  3. The exact and full URL or other location where you found the material
  4. Proof that you are the rights holder and a statement that, under penalty of perjury, you are the rights holder or are an authorised representative

Procedure

Upon receipt of notification the 'Notice and Take down' procedure is then invoked as follows:

  1. Newcastle University will acknowledge receipt of your enquiry by email or letter within ten working days, and will make an initial assessment of the validity and plausibility of the complaint
  2. If the initial assessment is that your complaint is potentially valid and requires further investigation or legal advice, the relevant material will be removed (or a request made to the hosting party if the material is hosted elsewhere) forthwith pending the outcome of the complaint
  3. Newcastle University will contact the contributor who deposited the material, if relevant. The contributor will be notified that the material is subject to a complaint, under what allegations, and will be encouraged to assuage the complaints concerned
  4. The complainant and the contributor will be encouraged to resolve the issue swiftly and amicably and to the satisfaction of both parties, with the following possible outcomes:
    • material is replaced on the Newcastle University website unchanged
    • material is replaced on the Newcastle University website with changes
    • material is permanently removed from the website
  5. If the contributor and the complainant are unable to agree a solution, the material will remain unavailable through the Newcastle University website until a time when a resolution has been reached
  6. Notice will be given via the website about materials that have been taken down to inform others who may have copies
  7. Newcastle University will (if necessary) take legal advice and, where it is practicable, support action, if necessary, against unofficial sites purporting to be in our name/not under our control that breach others’ rights
  8. Specific additional take down procedures may apply in special circumstances
