Aims

The aims of the module is to offer an overview of:
•       The definition, basic theoretical concepts and historical background of UK environmental law
•       The general legal framework and different regulatory regimes for the protection of the environment
•       Key aspects of the law concerned with pollution control, nature conservation and environmental impact assessment
•       A number of emerging themes within environmental law and policy

Outline Of Syllabus

The module covers the following issues: Introduction to environmental law and regulation, international environmental law, EU environmental law, theoretical background and environmental values. In addition the module covers a number of specific subjects of environmental regulation such as nature conservation, biotechnology, pollution control, climate change, and the role of private law in environmental protection. Finally, the module considers issues of environmental justice and access to environmental information and public participation.

Teaching Rationale And Relationship

Lectures establish the framework of knowledge and demonstrate aspects of technique. Seminars allow detailed application of knowledge and technique. The seminars will always require advance preparation. The private study takes the form of directed study following on from lectures and in preparing for seminars. The teaching method promotes knowledge and understanding of the subject matter and allows for the development of the skills of anlaysis, synthesis, critical judgement and evaluation.

Assessment Rationale And Relationship

The assessed coursework will give students the opportunity to develop and demonstrate their research skills, and their ability to understand the operation of law within the environmental law in general, and present coherent arguments supported by appropriate legal basis, precedent and policy argument. The coursework will offer students a chance to develop their interest in one of the topic areas studied in the module, developing research skills and encouraging deeper analytical study. Overall students will be able to demonstrate their cognitive skills, in particular research, synthesis, and critical evaluation.
