Aims

- To impart knowledge and develop critical awareness of the law of Patents and of the law of Trade Marks in the United Kingdom, these being two of the three major branches of Intellectual Property Law, along with some related areas of law such as the common law of passing off.

- To examine the above areas of law and their underlying principles in their International and European contexts.

- To develop an appreciation of the recent history of these areas of law and of the policy objectives that have informed this history.

- To develop associated theoretical, critical and communicative skills appropriate to FHEQ 6.

- An Introduction to Patent Law and Trade Mark Law as major branches of Intellectual Property Law

- The Foundations and Rationale of Patent Law

- The Positive and Negative Criteria of Patentability

- Patent Infringement and Defences

- Biotechnology, Gene Patenting and Ethical Issues in Patent Law

- Plant Breeders’ Rights

- The Foundations and Rationale of Trade Mark Law

- Registration of Trade Marks.

- Infringement of Trade Marks

- Defences and Use of Trade Marks in Advertising

- The Tort of Passing Off

Teaching Rationale And Relationship

The use of lecturing as the principal teaching method is justified by the technical nature of the subject and the need to provide initial exposition to assist students in achieving the requisite knowledge base. The seminars focus strongly on the skills outcomes and especially on the problem solving skills. The seminars provide the opportunity to demonstrate knowledge, understanding and application. The private study takes the form of directed study following on from lectures and in preparing for seminars.
